These Terms of Service govern your use of DayBrain, operated by George Hancock, trading as DayBrain (we, us, our). By using DayBrain you agree to these terms.

1. The Service

DayBrain is an AI-powered daily planning application available as a web app at app.daybra.in and as an Android mobile application. The service includes AI planning conversations, task management, journalling, and personal knowledge tools.

2. Eligibility

You must be at least 13 years old to use DayBrain. By using the service you confirm that you meet this requirement. If you are under 18, you confirm you have parental or guardian consent.

3. Account

You sign in to DayBrain using your Google account. You are responsible for maintaining the security of your account and for all activity that occurs under it. Please notify us immediately at support@daybra.in if you suspect any unauthorised use.

4. Subscription and Billing

DayBrain is a paid subscription service at £3.99 per month, following a 7-day free trial.

Your trial begins when you create an account. No payment is taken during the trial period.
After the trial, your subscription renews automatically each month unless cancelled.
You can cancel at any time. Cancellation takes effect at the end of your current billing period — you retain access until then.
Payments are processed securely via Stripe. We do not store your payment details.
Refunds are considered on a case-by-case basis. Contact support@daybra.in to request one.

5. Acceptable Use

You agree not to:

Use DayBrain for any unlawful purpose
Attempt to reverse engineer, hack, or disrupt the service
Use automated scripts or bots to access the service
Share your account credentials with others
Use the service in a way that could harm other users or us

6. AI-Generated Content

DayBrain uses Anthropic's Claude AI to generate planning responses and insights. AI-generated content is provided for informational and productivity purposes only. We do not guarantee the accuracy of AI responses. You are responsible for any decisions made based on AI suggestions.

7. Your Data

Your tasks, journal entries, and other content remain yours. We do not claim ownership of your data. See our Privacy Policy for full details on how we handle your data.

8. Service Availability

We aim to keep DayBrain available at all times but cannot guarantee uninterrupted access. We may carry out maintenance, updates, or experience technical issues. We will not be liable for any loss arising from service unavailability.

9. Limitation of Liability

To the maximum extent permitted by law, DayBrain and George Hancock T/A DayBrain shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

10. Changes to the Service

We may modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice of significant changes. Continued use after changes constitutes acceptance of the updated terms.

11. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of significant changes by updating the date at the top of this page. Continued use of DayBrain after changes constitutes acceptance.

12. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
